NGT notice to states, UTs for violating plastic waste management rules

April, 2017 :- A National Green Tribunal (NGT) bench,
headed by chairperson Justice Swatanter Kumar, issued on Thursday notices to
all state governments and Union territories on CPCB's application that plastic
waste management rules 2016 were not being implemented. The Central Pollution
Control Board (CPCB) has sought that the NGT impose "appropriate
penalties" under the "polluter pay principle" for
non-cooperation and "inaction" that has resulted in damage to health,
soil, animals, crops and groundwater. CPCB also appealed to NGT to direct
states to act on CPCB's direction issued on June 30, 2016 under section 5 of
the Environment Protection (EP) Act. CPCB had on June 30 directed the closure
of all unauthorised plastic manufacturing units and prohibited manufacturing of
substandard — less than 40 micron thickness carry bags. Under section 5 of the EP
Act the Centre has powers to issue binding directions to any authority.
